These are simple website terms of use suitable for a website that provides information about a business and its team.
If the website is also used for other purposes — for example, selling or supplying services or products (such as downloadable apps), or providing an online forum or noticeboard where users can post comments and other material — then additional or more detailed terms will be required to address the risks associated with those purposes.
If you expand these terms, you should consider Kenyan legal requirements, including the Consumer Protection Act, 2012, the Data Protection Act, 2019, and any applicable e-commerce or ICT regulations. These laws protect consumers from unfair contract terms, misleading practices, and improper handling of personal data. If any term is found to be unfair or unenforceable under Kenyan law, it may not be valid.
Because users of a website (end users) typically do not sign these terms in the traditional way, you must ensure there is clear evidence of acceptance. To achieve this, it is best practice to display a prominent link to the terms of use on the homepage and other key pages of the website. Many websites place such links in the footer alongside company information.
Where the website includes additional features (such as downloads or online services), you should require more explicit acceptance from users. For example, before a download can occur, the user should actively agree to the terms by clicking an “I Agree” button (or similar). In such cases, the page requiring agreement should either set out the terms of use in full or provide a clear, prominent link to them.
These terms may also include provisions for user accounts. The type of accounts contemplated here are limited to enabling a visitor to access password-protected areas of the site or to register for updates and communications from the website.
